引子：昨天在一个晚餐扯闲话，突然想到做为人民中的一员想要代表人民会不会很难呢？于是在网上搜了搜.

Definition:

人民代表大会制度: 是指拥有国家权力的我国人民根据民主集中制原则，通过民主选举组成全国人民代表大会和地方各级人民代表大会，并以人民代表大会为基础，建立全部国家机构，对人民负责，受人民监督，以实现人民当家作主的政治制度。 (法律词语)

Step 1: 成为选民

《选举法》第二十六条选民登记按选区进行，经登记确认的选民资格长期有效。每次选举前对上次选民登记以后新满十八周岁的、被剥夺政治权利期满后恢复政治权利的选民，予以登记。对选民经登记后迁出原选区的，列入新迁入的选区的选民名单；对死亡的和依照法律被剥夺政治权利的人，从选民名单上除名。

年满18岁的公民都应该有权利~

Step2: 成为区县级(选民直选)的人大代表候选人

第三十一条 由选民直接选举的人民代表大会代表候选人，由各选区选民和各政党、各人民团体提名推荐。选举委员会汇总后，在选举日的十五日以前公布，并由各该选区的选民小组反复酝酿、讨论、协商，根据较多数选民的意见，确定正式代表候选人名单，并在选举日的五日以前公布。

【不设区的市、市辖区、县、自治县、乡、民族乡、镇的人民代表大会的代表，由选民直接选举。】

问题1：如何提名？

Step 3: 成为省人大代表, 以至于全国人大代表

[全国人民代表大会的代表，省、自治区、直辖市、设区的市、自治州的人民代表大会的代表，由下一级人民代表大会选举]

县级以上的地方各级人民代表大会在选举上一级人民代表大会代表时，提名、酝酿代表候选人的时间不得少于两天。各该级人民代表大会主席团将依法提出的代表候选人名单印发全体代表，由全体代表酝酿、讨论。如果所提候选人的人数符合本法第三十条规定的差额比例，直接进行投票选举。如果所提候选人的人数超过本法第三十条规定的最高差额比例，进行预选，根据预选时得票多少的顺序，按照本级人民代表大会的选举办法根据本法确定的具体差额比例，确定正式代表候选人名单，进行投票选举。

问题2：如何让代表团同志不了解自己的支持自己（没有过交情的人）

2.1 如果要是代表团其他成员都是同一利益团体的，能提出异议么？

Reference 1：对这一条提出的质疑很有道理：这里有很大的弊端举例如下有一个区产生了10个区人大代表其中一个人大代表是由这个区的市民自己推荐并选出的他得到了90%的选票另外9个代表虽然只得到剩下的10%的选票，但他们在继续向上一级代表选举的时候缺可以具有9:1的力量

其他条件【reference 4】

想成为人大代表，一般需满足下面至少一个条件：

1、你是一个地方的主要领导（包括省、市、县、乡、村各个层次）；

2、你是一个行业的成功人士，并且要有相当的知名度；

3、你是妇女、少数民族；

4、你是民主党派或无党派人士；

5、你是一个成功的企业家，并且在社会关系方面表现良好。

在我国从最基层的乡镇人大代表一直到全国人大代表，基本上采取的方式是先协商后选举，各级党委根据各地实际先确定各个方面代表人数（如妇女线、企业线、少数民族线等），然后选择各线上的比较有代表性的人物进行协商，做好方方面面的工作后，进行选举。有一点还需明确的，上一层次的人大代表必然是下一级的人大代表。

亚裔男性果然是社会的弱势群体。。。。。

代表的权利

1、修改宪法；

宪法的修改，由全国人民代表大会常务委员会或者五分之一以上的全国人民代表大会代表提议，并由全国人民代表大会以全体代表的三分之二以上的多数通过。

2、监督宪法的实施；

3、制定和修改刑事、民事、国家机构的和其他的基本法律；

4、选举中华人民共和国主席、副主席；

5、根据中华人民共和国主席的提名，决定国务院总理的人选；根据国务院总理的提名，决定国务院副总理、国务委员、各部部长、各委员会主任、审计长、秘书长的人选；

6、选举中央军事委员会主席；根据中央军事委员会主席的提名，决定中央军事委员会其他组成人员的人选；

7、选举最高人民法院院长；

8、选举最高人民检察院检察长；

9、审查和批准国民经济和社会发展计划和计划执行情况的报告；

10、审查和批准国家的预算和预算执行情况的报告；

11、改变或者撤销全国人民代表大会常务委员会不适当的决定；

12、批准省、自治区和直辖市的建制；

13、决定特别行政区的设立及其制度；

14、决定战争和和平的问题；

15、应当由最高国家权力机关行使的其他职权。

16、全国人民代表大会有权罢免下列人员：

（1）中华人民共和国主席、副主席；

（2）国务院总理、副总理、国务委员、各部部长、各委员会主任、审计长、秘书长；

（3）中央军事委员会主席和中央军事委员会其他组成人员；

（4）最高人民法院院长；

（5）最高人民检察院检察长。

我觉得当人民代表太难了，我其实就是想提个问题

麻烦当了人民代表的人回答我一个问题，下列宪法条文还有用么？

《中华人民共和国宪法》第三十三条凡具有中华人民共和国国籍的人都是中华人民共和国公民。中华人民共和国公民在法律面前一律平等。

1. 少数民族的兄弟姐妹杀了人为啥不需要偿命？

《中华人民共和国刑法》 383条：个人贪污数额在十万元以上的，处十年以上有期徒刑或者无期徒刑，可以并处没收财产；情节特别严重的，处死刑，并处没收财产。

2. 老婆孩子公司名字底下的财产没收不？

这次回国，被和谐的网站之多，真是令我惊讶了一番；
令我不能理解的是我们的政府究竟怕什么？
13亿人的洋洋大国，治理起来是困难，
发展中的艰辛，资源的匮乏，国际环境的复杂……
中国的现状已经远远好于其他走同样道路的国家……
不足甚至错误都是难免发生的，我们又不都是刁民……

奇怪的就是，政府似乎总是要拿正派的面容示人，
一副只做对的的架势。
一个最简单的道理，能力的不足只有提高能力才能有所改观，
想捂住13亿人的眼，堵住13亿人的耳朵谈何容易。
况且这13亿人是深深热爱祖国的孩子，不满和宣泄都来自于这骨子里的爱，
我们诚心要反政府，就参加法轮功了，
何苦对着现实发表意见……
要是真是麻木不仁了……我们也可以像某国人民一样只看娱乐和体育报道
不满的时候射领导两枪……
房价这么高，生活这么累，物价这么涨……
大家乖乖的不出来闹事，是因为还有一丝丝的信心和希望……
说出来的话，提出来的问题都是这些希望的体现……
有些兴趣在禁止和打“*”下才被激发……

还记得扁鹊行医的故事，
齐桓公就是因为不能正视自己的疾病直至膏肓。
将这个编入教材的时候，有些人看了没……

一个有着世界1/5人口的大国，为虾米非要show GDP的增长给少数人看
美国只有特权阶级才关心国际经济状况，
这么高的增长率，难怪人家要生人民币的值……
像GDP的增长率这种浮云，难道真的比国人的幸福感更重要么？
还有世博会这种笑话，
为了航拍有树，你就把房子刷绿啊……祖国人民care么？
世博参观的人数对祖国人民有P的意义，
在世博期间稳定的物价才是意义……
这种只贡献数据的250事，少做一点好么？
我一点都不因为我们办了世界上最大的世博而骄傲，
相反在每个人6~7个小时的平均等待时间上还赶着人去的XX行为，真TMD....

我骄傲的是，祖国人民的聪明才智创造了动态的清明上河……
我骄傲的是，我们的城市建设，清洁（不是环境质量），还有治安……
我骄傲的是，美国人从未见过的中国式的美感
我骄傲的是，我的同龄人有着比美国人更广阔的视野，和事业心

昨天早晨在大家还都睡得酣畅的时候，我迎来了第一个CASL的shootout.

刚迎来的时候的确很高兴，因为预报周末天气晴朗，风和日丽。

事实证明，老天并没有分析天气预报。

上午第一场比赛下半时开始下雨，我主裁的第二场最大，直到第三场结束。

优于我看了预报，老天没有，所以对老天这种不负责任的行为，我是totally unprepared. 心里想骂，后来想想老天也不容易，连个家属都没有……

气温很低，但是天空居然不打雷，那就意味着game都还照常进行。

比赛都还挺好看的，好羡慕一边裹着毯子一边看球的家长们啊。

我的形象是越来越不cool了

第三场结束的时候我的手都插不进手套了，指头没有办法分开。

结束时候开车的时候因为手没有办法握紧钥匙，花了很久才打着车。

在车里吹空调的感觉竟然是如此的舒服……

后来听说，我不是最惨的。

最惨的一个懂得手都握不住哨子了。好歹我还能动一动，不然真要找人来帮忙打着车。

后来就在车里开着空调睡了一大觉，

起来已经2:30了，最后一场比赛结束5点钟，

赶紧买了双球鞋，3双球袜

不然今天我还得穿湿漉漉的鞋，

买了件黑色防雨近身的夹克……

洗了个热水澡……

真是不容易啊！！

去年就是这会儿在雨里跑完马拉松的，

……年年有今日啊~~So ungelivable !!!

就事论事，就球论球--我们差在哪里？

其实我并不是一个足够忠实的球迷，

没有一个自己所在城市所在国家的球队让我真正的体验到身为球迷的自豪感。

但是我是一个忠实的足球爱好者，虽然我踢得不好，可是我喜欢足球，我喜欢参与其中，我喜欢身临其境的参与。比赛和裁判，都让我感受到这个运动的可爱。

可，在我们的祖国，足球作为一项运动却没有给我们这样的机会足够得接近。职业联赛和人民中间有着很深的鸿沟。

在美国，成为一个裁判是很容易的事情，每年暑期在同一个地区 2hr车程内，有3个clinic可以选择。如果你愿意开得更远，机会会更多。而在中国，如果你不认识什么活跃其中的人，知道这些消息真的很难。我在互联网上实验过，点了半天，最后还需要打电话咨询，没有公布的时间，没有公布的地点。下面是我在美国做裁判时候的页面，

包括分配比赛，场地的地点，和每场比赛的收入都清清楚楚，还可以轻松管理自己的的日历。不光是寻常的赛季，每年周围还有很多锦标赛。……我们有这样的管理系统么？

而你看看我们祖国的足协界面，政治性的报告有多少~我只能苦笑一下。

美国的小孩踢足球有三个级别。Recreation,教练是volenteer, 裁判费用也很少，小朋友踢球就是为了好玩，

如果你有天分，move up到challenge level,教练就要certify了，队伍也会相对精干，比赛也多了些；

到了Classic level小朋友就为了俱乐部比赛，在这里闪光的很有可能入选 Olympic development program,

当然Middle school 和 High school小朋友也有机会进入足球这一行，而且有些高中提供足球奖学金。

从群众到一个职业球员的路很公平对每一个人来说，

但我认识的一个中超球员，家里为了供他踢球，不得不把他从小送到沈阳，花费一共高达100多万……

我只能说，不是我们没有利害的孩子，是在学钢琴的机会成本比成球星要低多了。

即便是承认，注册一个非职业球员一年是35刀，会被安排球队和比赛……我们可爱的足协给我们这样的机会了么？

可爱的足协，假球的事我们不讨论，我也不关心。作为一个协会，成功得让这么群众化的运动如此得脱离群众，实在是让人不敢相信。

之后，就是我听说的事了。

一旦进入国家队，年薪会涨到30万，一旦受伤，收入低于每年10万……没有insurance

这项政策市谁定的?不过必然鼓励我们的队员不要拼命……

还是俱乐部的比赛比较重要吧……

而英国~俱乐部会承担队员在国家队受伤后的补偿；国家和大赛也逐渐加入补偿系统

不管是谁出钱，球员受伤时有保障的~~

除了在中国，非洲也没有……你晓得他们为啥也没有其他球队拼命了吧。为啥我们中青队比国队强了吧。

让我们的球员不能安心比赛的政策~很奇怪吧，俱乐部老板在他们去国队之前都会谈话，毕竟小伙子，还是拿工资比较重要。我也觉得是，我要是国队队员也不会去拼命的，放着30万年薪不去拿，顶着危险为了超过70%工资减低和不受保障的医药费……作何选择；

我在国内上裁判课的时候，听说一句没有一场职业球赛不是假球……挺讽刺的啊，不过世界各地都一样。

可摆脱演员们敬业一点，让你们的表演真实一点。就要苦练演技的呀……演技不好，不是打击观众积极性么……

就算意大利足球黑，人家演技在哪里摆着。不要是本事练好就出来显眼。大家都要从0开始的，好好踢，好好爱自己的足球。

读的是一篇“ 羡慕朝鲜，不如羡慕自己”的文章

首先我声明，我不羡慕朝鲜

然后我要谈谈天朝的足球风气。~要知道，虽然光靠着二杆子的精神往前冲是傻了些，我不希望中国队如此踢球。问题是，我们的国足的国家荣誉感未免也……不谈国家荣誉感，作为一个职业球员，体育精神总是有的吧。瑞士拿下西班牙不是国家荣誉感所迫吧~~。谭飞腿，郑红牌……你能不⊙﹏⊙b汗么？

中国队输，输在没有求胜心；中国足球输，输在这帮领导从来没有关心过怎样培养底层球员对体育的热爱。我们的球员不是战士，是一堆求职者，是一堆本来对足球兴趣不很强烈的打工者。

试问问，群众不是不想热爱足球，我们可爱的政府从来没有想过扶持过这种运动。小朋友踢个球多难啊，小朋友们宁愿学习弹钢琴和奥林匹克数学。我们的体育奖学金是用来安顿已经成名的运动员，没有鼓励孩子积极投身体育事业的作用，除了少数高校，这个小学高中的优质体育场都是为了给上级领导看的。

……

我不评论朝鲜人，输家就是输家。一个头顶上写了Loser的中国足球……中国球迷对别的国家的国家队那样的支持，那样的抱憾，你以为我们想啊！！

…… 人家巴西比我们富裕么？人家日本比我们人口密度小么？人家韩国比我们身体素质强么？人家美国比我们智力高么？

看看我们的篮球，亚洲称霸了吧，连田径都TMD比足球发展好。我们的一次次的失望换来的是更多的失望。好教练被排挤，热心群众足球的组织被“剥削”，裁判的黑幕被揭穿

足球说归说是体育呀，体育精神总要有的吧！！

这辈子最大的愿望之一：周末在草地边上看自己的孩子踢球。请问这个对于中国的家长来讲不是遥不可及的奢望么？？ Shame on us~shame on us~

我想回国的时候，我还能做10年的当地低级裁判员，我能为小朋友们服务。我能有一天对别人说，我支持的是我们的国足~而且我们的国足不需要先感谢国家 (*^__^*) 嘻嘻……

China Kills Hummer Deal

Hummer is officially dead. Probably. General Motors announced that it would begin winding down the firm yesterday once the news came that Chinese regulators would not approve Sichuan Tengzhong Heavy Industrial Machines Co.'s acquisition of the company. But is Hummer really finished?

Here's what GM says, according to the Associated Press:

GM said it will continue to honor existing Hummer warranties.

"We are disappointed that the deal with Tengzhong could not be completed," said John Smith, GM vice president of corporate planning and alliances. "GM will now work closely with Hummer employees, dealers and suppliers to wind down the business in an orderly and responsible manner."

Well that sure sounds final. But remember what happened with Saab? There, GM's initial sale failed and it looked like Saab would be wound down. At that time, I quoted this passage from a Bloomberg article:

GM has a contingency plan for Saab similar to a process being used to wind down Saturn, the person said. Saab owners would continue to be covered by GM warranties and be assigned to a new dealership for service, the person said.

Sound familiar? But two months later, GM managed to complete a deal with another firm to ensure Saab's survival after all. Could that happen here?

Maybe, but it might be harder this time. Sichuan Tengzhong was only going to pay a measly $150 million for Hummer in the first place. Saab's original deal was for $600 million. How much less would GM accept? It's pretty clear that no one is willing to pay much for a company that's business focuses on stamping out big fuel hogging SUVs. After all, Chinese regulators clearly didn't want one of their companies taking it on. With the auto industry running in the opposite direction of such vehicles, it's hard to blame them.

Stress constant stress surrounding me and my busy busy lify in Tsinghua. Bless me to be the lucky one wonning the national schoolarship. Bless me could entered the university which I dreamed of for almost one year

Believe me release of Pressure already began at 12,1st,2006 with the last mail has been send. Now I care about only normal courses and exams.

for the next year, still two more courses I should audit. But I learn them for fun

I think I should forget about school schedues for whole winter; find some place to shoult out my mind and take a rest.

Tsinghua Finnally be a memory of my. Within it I met my dearly friends and respectful teachers who enable me to be such a capable girl.

Although I complain and complain again, I complain those "crab teachers" in Tsinghua, because deep in my heart, Tsinghua should be perfect. Actually Tsinghua has nothing wrong with those crabs, the wrong is on us. I never try to speak out , so how should my dear Tsinghua ever know.

Never mind, Those crabs has little effect on me. On the contrast, I know how to discover resources that I might miss if I keen on my education plan. Auditing other courses not only gives me an opputunity to make up for my study, also let me meet other students, make more friends.

I hope next and nest batch of body design orientation will have better education than us. Those crabs could be excluded from my dear Tsinghua. And better future for all the students here
